1.1. In these Conditions:
‘BUYER’ or ‘CUSTOMER’ means the person who accepts a quotation of the Seller for the sale of the Goods and/or the Services or whose order for the Goods and/or the Services is accepted by the Seller.
‘GOODS’ means any goods (including any installment of the goods or any parts for them) which the Seller is to supply in accordance with these Conditions.
‘SELLER’ means TELECONTROLLI.
‘CONDITIONS’ means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Buyer and the Seller ‘CONTRACT’ means the contract for the purchase and sale of the Goods and/or the Services.
‘SERVICES’ means any services which the seller is to provide in accordance with these conditions.
‘WRITING’ includes telex, cable, facsimile transmission and comparable means of communication.
1.2. Any reference in these Conditions to any provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time.
1.3. The headings in these Conditions are for convenience only and shall not affect their interpretation.
2. Basis of the sale
The offer and sale on the web site TELECONTROLLI integrate a distance contract governed by artt. 50 ss. Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree No 9 April 2003. 70 (Law on Electronic Commerce). The purchase of products is intended for consumers.
The present sales conditions govern the relationship between the customer and TELECONTROLLI for the purchase of products on the Site. The Customer must carefully read the terms and conditions that TELECONTROLLI makes available also in order to enable playback and storing remember Conditions in compliance with art. 12, co. 3 of Legislative Decree. N. 70/2003.
3. Purchase Process
For the purchase of the Products the Customer must proceed to register by entering their personal details, following the instructions provided by the website, and will have to complete and submit to TELECONTROLLI the purchase order form in electronic format available on the site by following the instructions contained in the Site. Purchase orders must be accurately filled out in their entirety. The customer will have to enter the Product/s selected into the "Shopping Cart" and, after having read and accepted the contribution for delivery costs, may proceed to purchase. Should the Customer need to change the order of purchase or for the information contained in it shall follow the proper procedure to change contained in the site. In particular, the Customer shall be entitled to change the amount of products they intend to purchase, adding or deleting one or more Products from the Cart.
After this transaction, the customer will display a screen containing a summary of the purchase order, including the delivery and handling, by asking for a further confirmation of the purchase process. After the display of the list the customer must select the type of payment and "click" the button "Checkout".
4. Completion of the Agreement
With the confirmation of the purchase order by the Customer, the terms of sale and the additional information contained on the site is deemed fully known and accepted by the customer. TELECONTROLLI sent via email indicated constitute acceptance of the contract proposal. The contract will be concluded, and shall be binding on both parties, when the Order Confirmation will be sent to the customer. TELECONTROLLI sent you an email with an order confirmation which includes a mention of the product/s purchased; the indication of the price; method of payment; delivery cost; the right of withdrawal, in accordance with provisions of article 13 of Legislative Decree. n. 70/03.
After payment the Customer will receive an email with the receipt of payment and by that time will decorate the timelines for preparation and shipping of his order; If TELECONTROLLI staff had to find errors in customer’s order or the order does not deem evadibile in the time and manner required, the Customer will be informed immediately that his order has been REFUSED. So if the Customer should receive such a message, please contact us by phone. And 'excluded any right of the Customer to damages or compensation, and any contract or tort liability for direct or indirect damages to persons and/or property, caused by the rejection, even partial, of an order or cancellation due to failure payment within the prescribed period.
All features, content, specifications, products and prices of products and services described or depicted on the Site are subject to change at any time without notice. Certain weights, measures and similar descriptions are approximate and are provided for convenience purposes only.
TELECONTROLLI makes all reasonable efforts to accurately display the attributes of our products, including the applicable colors. The inclusion of any products or services on the Site at a particular time does not imply or warrant that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any item purchased from the Site.
By placing an order, you represent that the products ordered will be used only in a lawful manner. We attempt to ensure that information on this Site is complete, accurate and current. Despite our efforts, the information on the Site may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currentness of any information on the Site. For example, products included on the Site may be unavailable, may have different attributes than those listed, or may actually carry a different price than that stated on the Site. In addition, we may make changes in information about price and availability without notice.
5. Prices, Payment and Shipping
For shipment we use the address provided during registration to the site, then carefully fill in the full address field in its entirety. After receiving e-mail notification of shipment the courier will deliver within the timeframe set depending on the locations to be served. We suggest you contact the carrier directly if you were not at home to arrange for delivery at specific times in order to avoid incurring additional costs.
6. Shipping and Returns
When an order is placed, it will be shipping to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on the Site and with US law. All purchases from the Site are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from the Site pass to you upon delivery of the items to your specified shipping address (DAP, buyer's shipping address, Incoterms® 2010) unless otherwise specified in writing. You are responsible for contacting us to initiate any claim for damaged and/or lost shipments. You are responsible for paying any import duties and taxes on your order. SparkFun does not do business with entities in, or who intend to reexport any product to, a country embargoed by the government of the United States. Currently, the only countries we do not ship to are Cuba, Iran, North Korea, Sudan, and Syria. You are responsible for ensuring no product purchased from SparkFun is transported through or to one of those countries.
A) 90 day unmodified return policy If you are not 100% satisfied with your order, we will be happy to arrange a return for any unused items purchased within 90 days. Simply contact us filling out the form at www.telecontrolli.com/contact-us/contatto.html and specify in the message the reason. If you have modified or tested your parts, please see our Modified product return policy.
B) Modified product return policy Sometimes you can’t tell if something is wrong until you test it. No worries! We won’t leave you hanging. If you have modified your part and something goes wrong or you aren’t satisfied with your item, our fantastic team of dedicated technicians who can help trouble shoot, offer advice and determine if your parts are defective. In the event that something is determined to be a manufacturer error or failure due to defective materials, we will repair, return or exchange the item(s) as needed. Please contact Tech Support with your order number, description of your setup, and any information about your situation that may help and we’ll see what we can do for you.
C) Damaged in Shipment Please email Customer Service right away. Include a description of the damages, and pictures if possible. This information is very helpful to us in assessing how we package our orders and helps prevent similar problems in the future. We’ll get replacements for the damaged goods out to you as quickly as possible.
D) General Return Guidelines - Please arrange an RMA with us prior to sending any returns back to us. - All returns must include any accessories, documentation, etc. that shipped with the product. - If your return includes Lipo batteries, please contact us from more details on proper shipping procedures. - If the item has been soldered to please do not remove, desolder, or otherwise modify any connected items before contacting Tech Support. - Eligibility for return of modified items is determined on a case-by-case basis; we can not guarantee eligibility for modified items. - Returns may take up to 2 weeks to process, not including transit times. - Replacement orders can not be modified to include different or additional parts. - You are responsible for return shipping charges that are not related to a manufacturer error. - Returns for orders older than 90 days are eligible for replacement or store credit only. - We reserve the right to limit support, and deny returns on items that were purchased over a year ago, ding and dent items, or old version releases. - In the event that your return is not received in restockable condition, we reserve the right to change your refund method to store credit only. SparkFun accepts returns for any unmodified product for any reason within 90 calendar days from the date of receipt of merchandise. After such time, requests for return will be considered but are not guaranteed to be accepted. "Unmodified" means a product that is in the same condition in which it was received. TELECONTROLLI guarantees that the sold goods are free from material and manufacturing defects. The Client shall denounce to TELECONTROLLI in writing the existence of any delivered product defect within 8 (eight) days after reception of the products. TELECONTROLLI recognizes to the Client a warranty period of 12 months for its Products. The denounced defects covered by the warranty shall be: - functional defects (performance different than data sheet values) - aesthetic defects (non-functional defects ) Telecontrolli shall examine functional defects in any case. TELECONTROLLI shall examine aesthetic defects only if they account for more than 10% of the delivered quantity. TELECONTROLLI reserves from now on the right to return the amount paid to the Client related to the selling price of the products or, alternatively, will have the right to repair and / or replace, at its convenience and expense, products that TELECONTROLLI recognizes as being affected by defects within the warranty period stated above. Any transport costs are charged to the client.
TELECONTROLLI is not obligated to provide assistance under this Article to repair any damage resulting from improper use of the goods or their connection to unsuitable equipment. TELECONTROLLI is not responsible for any damage caused and / or related to unforeseeable events that are beyond the control of TELECONTROLLI.
8. Right of withdrawal
Ai sensi e per gli effetti degli artt. 64 e ss. D. Lgs. n.206/05 il Cliente potrà esercitare il diritto di recesso, senza alcuna penalità e senza specificare il motivo. Il Cliente dovrà seguire questa semplice procedura:
A) Inviare a TELECONTROLLI entro 2 giorni lavorativi dal ricevimento del Prodotto, con lettera raccomandata con avviso di ricevimento, la propria volontà di recedere dal contratto;
B) Provvedere, utilizzando un corriere a propria scelta, alla spedizione del prodotto a TELECONTROLLI – Via Nazionale delle Puglie 177 – 80026 Casoria (NA) accuratamente imballato nella confezione originale inserendo al suo interno copia della raccomandata spedita.
B1) La comunicazione potrà essere inviata, entro lo stesso termine, anche a mezzo telegramma, posta elettronica e fax, a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le 48 ore successive.
B2) TELECONTROLLI procederà, tramite bonifico bancario, al rimborso relativo al costo indicato nell’ordine d’acquisto ed alle prime spese di spedizione, ovvero a quello relativo ai Prodotti per cui è stato esercitato il diritto di recesso, entro 30 giorni lavorativi successivi al ricevimento dei Prodotti.
B3) L’esercizio del diritto di recesso sarà privo di efficacia qualora il prodotto restituito non sia integro, ovvero manchi l’imballo originale, ovvero per assenza di elementi integranti del prodotto, o per danneggiamento del prodotto per cause diverse dal trasporto. Il cliente accetta che in caso di controversie il foro competente sarà quello di Napoli.

All products and services purchased on or through the Site are subject only to any applicable warranties of their respective manufactures, distributors and suppliers, if any. To the fullest extent permissible by applicable law, we hereby disclaim all warranties of any kind, either express or implied, including, any implied warranties with respect to the products and services listed or purchased on or through this web site. Without limiting the generality of the foregoing, we hereby expressly disclaim all liability for product defect or failure, claims that are due to normal wear, product misuse, abuse, product modification, improper product selection, non-compliance with any codes, or misappropriation. We make no warranties to those defined as "consumers" in the Magnuson-Moss Warranty-Act. The foregoing exclusions of implied warranties do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions. TELECONTROLLI does not approve or recommend the use of our products or resources in critical life-support or medical devices, or for any use or application in which the failure of a single component could create a situation in which property damage, personal injury or death is likely to occur. You absolve TELECONTROLLI in question of all damages, costs, and expenses that may be incurred, including without limitation, attorney fees and costs related to any lawsuit or threatened lawsuit arising out of the use of our products in unauthorized applications.
11.Limitations of Liability
TELECONTROLLI assumes no responsibility, nor will be liable, for any damages to, or any viruses or malware that may infect your computer, telecommunication equipment, or other property caused by or arising from your access to, use of, or browsing the Site, or your downloading of any information or materials from the Site. In no event will TELECONTROLLI or any of its respective officers, directors, employees, shareholders, affiliates, agents, successors or assigns, nor any party involved in the creation, production or transmission of the Site, be liable to you or anyone else for any indirect, special, punitive, incidental or consequential damages (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of the Site, any web sites linked to the Site, or the materials, information or services contained on any or all such web sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. The foregoing limitations of liability do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions.

These terms of service may be revised at any time and from time to time by updating this posting. You should visit this page from time to time to review the then current terms of service because they are binding on you. Certain provisions of these terms of service may be superseded by legal notices or terms located on particular pages of the Site.
13. Governing law and jurisdiction
These terms of service supersede any other agreement between you and TELECONTROLLI to the extent necessary to resolve any inconsistency or ambiguity between them. These terms of service will be governed under Italian Law; the competent judicial authorities in any dispute arising from the orders, including on routes and/or letters of credit, will only be the Forum of Naples. The United Nations Convention on Contracts for the International Sale of Goods will not be applied.
You or we may suspend or terminate your account or your use of the Site at any time, for any reason or for no reason. You are personally liable for any orders placed or charges incurred through your account prior to termination. We reserve the right to change, suspend, or discontinue all or any aspect of the Site at any time without notice.
